CONTRACT

Your contract will be with Galapagos Outdoors CL, (Galapagos Outdoors Travel) a company registered in Ecuador (registration number 1711690022) and will be subject to Ecuador law at all times.

RESERVATIONS

For a Galapagos trip we recommend making reservations several months in advance in order to guaranteed availability and low airfare. For arrange a payment for the inicial deposit, call or email us for providing you all information you might need. The initial deposit is calculated as 20% of the total cost of your trip.

PAYMENTS

This deposit must be paid upon confirmation of all services. For Galapagos tours we require full payment 60 days prior to the date that services are scheduled to begin. For last-minute reservations made fewer than 59 days prior to departure, we require full payment upon reservation. Special policies may apply for allotments, series and specific bookings during high season. We will issue a final invoice when all services are confirmed (for third party suppliers, payment will be requested according to operator policies). All our rates are in US Dollars.  All payments may be made in US Dollars by credit card, US bank transfer, international wire transfer, or as previously arranged.

CANCELLATIONS

All reservations cancelled fewer than 90 days prior to departure (computed by date of receipt of written cancellation notice) are subject to the following schedule of fees:

  • 89 to 60 days prior to departure, 10% of the full price will be forfeited.
  • 59 to 45 days prior to departure, 25% of the full price will be forfeited.
  • 44 to 30 days prior to departure, 50% of the full price will be forfeited.
  • 29 days or fewer prior to departure, full payment will be forfeited.
  • Last minute bookings:
    • If reservation was made 15 days before departure and you cancel 12 day in advance – You will be charge 50% of the full price will be forfeited.
    • If reservation was made less than 15 days before departure and you cancel after 12 days before your trip – Full payment will be forfeited.

CANCELLED TRIPS

GALAPAGOS OUTDOORS LLC reserves the right to cancel any trip prior to departure for any reason whatsoever. The refund of all payments received shall release GALAPAGOS OUTDOORS LLC from any further liability. GALAPAGOS OUTDOORS LLC is not responsible for expenses incurred by trip members in preparing for a cancelled trip (e.g., air tickets, visa fees, inoculations, equipment, etc.) Any expenses incurred in the refund of money due to a cancellation will be deducted from the total amount to be reimbursed.

PRICING

In general, our listed rates for fixed departure dates are the lowest rates available for any trip. For non-fixed departures, the price paid per person will vary depending on the number of participants. GALAPAGOS OUTDOORS LLC’ staff, guides or Tour Leaders are not included in the pricing count.

SINGLE SUPPLEMENTS

All pricing is based on double accommodation. Participants who desire single accommodation should request this arrangement in advance. If single accommodation is available, participants will pay a single supplement, which varies by hotel and room.

RESPONSIBILITIES

GALAPAGOS OUTDOORS LLC reserves the right to change or withdraw any travel arrangements when deemed necessary or in the best interests of our clients. This is especially applicable when faced with unforeseen weather conditions that prevent us from running a trip safely. We reserve the right to refuse service to any passenger should he/she jeopardizes group safety or engages in illegal, abusive, or offensive behavior. Luggage travels at the owner’s risk throughout the tour, although we take all necessary precautions.

We are not responsible for the cancellation of any services due to natural disasters, social upheavals or other circumstances out of our control.

Participants have the responsibility to select a trip appropriate to their abilities and interests. In order to assist you, required effort is listed for each trip. We are also happy to discuss the details of trips and activities with you. Trip members are held responsible for being in sufficient health to undertake the trip. Trip members are responsible for preparing for the trip by studying the itinerary and pre-departure information sent by GALAPAGOS OUTDOORS LLC and for bringing the appropriate clothing and equipment as advised therein.

INCLUSIONS AND EXCLUSIONS

Meals: Meals provided are specified on itineraries as breakfast (B), lunch (L), picnic lunch (PL), Snack (S), and dinner (D). Spring water is included with all meals, but soft drinks, juices, and alcohol are not included unless specified. Some trips do not include full meals, but you may request them at an additional cost.

Airfare: The prices of our trips DO NOT include airfare unless specified. We are happy to reserve and sell the necessary airline tickets for your arrival and departure. Prices vary according to the season.

Airport transfers: International and domestic airport transfers are not included unless specified.

Entrance fees: Our trips DO NOT include entrance fees to national parks, reserves, or protected areas.

Guides and transportation: All of our trips include the services of one licensed, bilingual guide (English / Spanish) and or assisted by our staff (Drivers / Interpreters). All activities specified in itineraries are guided. Our trips include all necessary land transportation in safe, private or share services,pick up, 4×4 vehicles, vans, and/or buses.

RESERVATIONS AND PAYMENT

A deposit is required and will be advised at the time you request the booking. This must be received within five days of booking to secure a reservation. All balances are due 70 days prior to departure. Special payment policies may apply and will be advised at time of reservation. If payment is not received by the due date, airline and all other reservations will be cancelled. Galapagos Outdoors Travel, is not responsible for any penalties, fare increases or fees incurred due to late payment. Submission of payment to Galapagos Outdoors Travel signifies the acceptance of the Terms & Conditions of Sale.

FORMS OF PAYMENT

Payment may be made by wire transfer or debit and credit cards from American Express, Visa or MasterCard.

FOREIGN TRANSACTION FEES

Galapagos Outdoors Travel never charges you to use your credit card. Although cases are very rare, we suggest you check with your bank to see if they charge any foreign transaction fees.

CUSTOMER IDENTIFICATION AND PROOF OF CITIZENSHIP

The Transportation Security Administration (TSA) requires all airline passengers traveling on and after November 1, 2010 to provide the following Secure Flight Passenger Data (SFPD) regardless of when the reservation was booked:

  • Full Name as it Appears on Government-Issued Passport
  • Date of Birth
  • Gender
  • Redress Number (If Available)

Names provided to Galapagos Outdoors Travel for customers must be an exact match to the passport that will be used during travel. The customer is responsible for all fees and expenses that may be incurred due to an incorrect name, or to the denial of travel due to an incorrect name. A name revision fee of $50 per person will be assessed by Galapagos Outdoors Travel for name corrections or revisions, in addition to other fees assessed by airlines or other suppliers. Updated information regarding security measures and requirements for air travel are available at www.tsa.gov. It is highly recommended for the customer to check this website for possible changes due to security measures and air travel for their scheduled destination(s).

It is the customer’s responsibility to verify current entry requirements and obtain the necessary travel documentation based on the country of origin, destination and any countries in which a stop is scheduled.

An entry visa may be required. It is the customer’s responsibility to verify that a passport is valid at the time of departure, remains valid for a minimum of six months beyond the return travel date, and contains sufficient BLANK pages to attach any required visas for their travel. Some countries may require that children under 18 years of age must travel with the consent of both parents. Please verify the most current documentation and entry requirements with the country’s consulate, an immigration office or at travel.state.gov. No refund will be issued for losses incurred as a result of failure to obtain or provide required valid documentation.

Notice on Aircraft Cabin Insecticide Treatment: Some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. A list of such countries is available at:

DOCUMENTS

Documents will be issued on fully paid reservations approximately 28 days prior to departure.

CHANGES PRIOR TO DEPARTURE

Galapagos Outdoors Travel will assess a fee of $150 for customer-initiated change to the reservation after receipt of payment, and additional airline, hotel and/or supplier fees may also be charged. Any change made will result in the reservation being re-priced at the rate in effect at the time of the change. A “name change” constitutes a cancellation and cancellation fees will apply.

CANCELLATIONS & REFUNDS

Galapagos Outdoors Travel will assess a fee for cancellations. This fee depends on the date when we receive notification of your request to cancel your reservations. Your initial deposit is non-refundable.

More than 150 days – Cost of deposit including flights

150 to 120 days – Cost of deposit including flights plus 10% remaining price of itinerary

119-90 days – Cost of deposit including flights plus 20% remaining price of itinerary

89 – 70 days – Cost of deposit including flights plus 50% remaining price of itinerary

69 – 60 days – Cost of deposit including flights plus 80% remaining price of itinerary

59-31 days – Cost of deposit including flights plus 90% remaining price of itinerary

30-0 days – Cost of deposit including flights plus 100% price of itinerary

If you have a policy of insurance you may find that a refund of your losses may be possible.

Once travel has begun, there will be no refunds for any unused or partially used travel component for any reason. While every effort will be made to provide all items on the travel itinerary as booked, Galapagos Outdoors Travel reserves the right to cancel or alter any reservation for any reason prior to departure. Should this occur, refunds will be made without any further obligation by Galapagos Outdoors Travel .

With respect to the travel arrangements made in connection with this transaction, Galapagos Outdoors Travel, represents and acts as agent for disclosed principals and independent contractors, including carriers, transportation companies, tour operators, wholesalers, service companies, hotels, etc. Galapagos Outdoors Travel, is not responsible or liable for any acts, omissions, financial stability, delays or changes by any of these entities. Neither Galapagos Outdoors Travel nor any of its representatives shall be or become liable or responsible for any loss, injury, damage to person, property, or otherwise in connection with any accommodations, transportation or other services resulting directly or indirectly from any extraordinary circumstances, including but not limited to acts of God, dangers incident to the sea, fire, breakdown in machinery, acts of governments, de jure or de facto, war, hostilities, civil disturbances, strikes, riots, thefts, epidemics, medical quarantines, customs regulations, defaults, delays or cancellations of or changes in itinerary, routing or schedules from any cause beyond the control of the Galapagos Outdoors Travel, or from any loss or damage resulting from insufficient or improperly issued passports, visas or other documents.

NO SHOWS

Failure to travel without prior notification is considered a no-show and the entire cost of reservation is non-refundable.

PRE-DEPARTURE CHANGES BY GALAPAGOS OUTDOORS TRAVEL

It is occasionally necessary for us to make changes to the advertised vacations. Most of these are minor changes and where we know in advance, we will notify you as soon as possible. Minor changes include change of airline or type of aircraft, flight timings of 12 hours or less and a change to accommodation of a similar standard.

It may be necessary to make a major change to your vacation such as offering hotels of a lower standard or a change of destination. In this case, we will do our best to offer you a suitable alternative, with a price refund if appropriate or allow you to change to an alternative vacation. Some tours may require a minimum number of participants and if that number is not reached, the tour may have to be cancelled or amended. If you are not happy with the alternative offered, we will gladly offer a full refund.

CHANGES AFTER DEPARTURE

No refunds will be granted on unused services once travel has commenced. Galapagos Outdoors Travel, will assess a $100 per person fee for changes made after commencement of travel. Changes in return transportation to the extent permitted by carrier(s)’ tariff may be made only through Galapagos Outdoors Travel ’s representatives. Changes in travel arrangements that result in additional monies owed due to price differences, fuel surcharges, ticket re-issuance fees, etc. are due and payable directly to Galapagos Outdoors Travel ’s representatives at time of change.

RATES

All rates are quoted in U.S. Dollars unless otherwise noted. Rates are subject to change at any time, without notice. Galapagos Outdoors Travel reserves the right to make adjustments if a particular rate was incorrectly stated. Galapagos Outdoors Travel can guarantee air rates only for reservations paid in full; it is therefore recommended that full payment for air fares be made at time of booking. Airline tickets must be issued to guarantee against rate increases, fuel surcharges and to avoid cancellation of airline reservations. Government and supplier-imposed taxes and fees are subject to increase at any time and are not covered by Galapagos Outdoors Travel. Rates do not include Airline baggage or seat assignment fees or other ancillary fees, passport and visa fees, some departure taxes, gratuities, meals, beverages, insurance, telephone calls, additional bedding charges, laundry service, and other miscellaneous charges of a personal nature are not included except where specifically noted.

AIR TRANSPORTATION

Galapagos Outdoors Travel has no control over and assumes no liability for airline strikes, schedule changes, flight delays, flight cancellations or other airline initiated changes. In the event of such an occurrence, the airline is responsible and will determine what action will be taken.

ACCOMMODATIONS

Facilities, guest services and amenities are provided at the discretion of the hotel and are subject to change without notice. Any additional costs are the responsibility of the customer and are payable directly to the hotel. Room location, connecting rooms and bedding requests are not guaranteed and are based upon availability at time of check in. Hotel descriptions and photos do not necessarily depict the actual room in which guests will be accommodated; maps and images may not be exact or to scale, and are for general description purposes only. Room standards are the sole responsibility of the hotel. Hotel ratings are based on information provided by the hotel and Galapagos Outdoors Travel ’s own evaluations.

BAGGAGE AND PERSONAL PROPERTY

Baggage checked or carried on board an aircraft or vehicle are subject to fees based on weight, number and size. All baggage fees are the responsibility of the customer and are payable directly to the supplier. Please contact the supplier for their current baggage policy. Galapagos Outdoors Travel is not responsible or liable for any delay, loss or damage to baggage and personal property.

PHYSICAL DISABILITIES

Customers requiring special facilities, services or accommodations must disclose such needs to Galapagos Outdoors Travel at time of reservation. Wheelchair-accessible transportation and accommodations may be requested, but cannot be guaranteed. Available accommodation standards vary by hotel and are not within the control of Galapagos Outdoors Travel. Your foreign destination may not conform to the United States’ Americans with Disabilities Act requirements, and facilities for disabled persons may be extremely limited. Galapagos Outdoors Travel assumes no liability for the failure for the provision of accommodations by a travel vendor.

RESPONSIBILITY

Galapagos Outdoors Travel is only responsible for reserving the items listed in the reservation details. The suppliers providing transportation, sightseeing arrangements, tours, excursions and accommodations (“Suppliers”) for the vacations are independent contractors and are not agents, affiliates, representatives or employees of Galapagos Outdoors Travel. Galapagos Outdoors Travel, has no ownership interest in any Supplier. Any use of the Galapagos Outdoors Travel name by a Supplier is for identification purposes only and does not constitute ownership, agency, supervision or control by Galapagos Outdoors Travel . All documentation, receipts and tickets are issued subject to the terms and conditions specified by the Supplier. By utilizing the services of the Suppliers, you agree that Galapagos Outdoors Travel not shall be liable for

(1) any accident, loss, injury or damage to you or to those traveling with you in connection with any accommodations, transportation or other services or resulting directly or indirectly from any occurrences or conditions including, but not limited to, negligence, defects in vehicles, equipment malfunction, strikes, “Acts of God,” riots, terrorist acts or threats, wars, acts of governmental authority, theft, delays, weather conditions, environmental conditions, bankruptcy, cancellations or changes in itineraries or schedules or

(2) loss or damage to property or injury to persons, caused by reason of any act or omission, intentional, negligent or otherwise by such third party Suppliers. Galapagos Outdoors Travel makes no implied or express warranties in the offering of any vacation described in these materials.

Remember that all travel documents and required personal identification, as well as compliance with agricultural regulations are your responsibility. The terms under which you agree to take a vacation cannot be changed or amended except in writing, signed by an authorized officer of Galapagos Outdoors Travel. The customer contract in use by the airline, when issued, constitutes the sole agreement between you and the airline. Galapagos Outdoors Travel reserves the right to decline to accept or retain any person as a member of the vacation at any time prior to departure or during the course of the vacation. In the unlikely event that the services or accommodations are not available as stated, due to reasons beyond Galapagos Outdoors Travel’s control, efforts will be made to provide services or accommodations of equal standard and quality. If you have any reason to complain, please notify the supplier at the time so that matters may be put right at the earliest opportunity. If you remain unhappy please email or telephone us as soon as possible. If you wish to take the matter further at the end of your vacation please contact at Galapagos Outdoors Travel at Galapagos Outdoors Travel, Bentima House, 168-172 Old St, London, EC1V 9BP  in writing or by email within 30 days of your return regarding service issue disputes

LIMITATION OF LIABILITY

By making a reservation, customer acknowledges that in all events Galapagos Outdoors Travel shall not be liable for any incidental or consequential damages and that the sole extent of Galapagos Outdoors Travel ’s liability, if any, shall never exceed the amount actually paid by customer to Galapagos Outdoors Travel .

These Terms and Conditions of Sale are subject to change at any time at Galapagos Outdoors Travel ’s sole discretion without notice. Any dispute arising out of any vacations offered shall be subject to the exclusive jurisdiction of the Ecuador courts
